Supplementary affidavit filed today is taken on record.
In view of the statement made by the learned counsel for the petitioner as recorded in the order dated 28.05.2019, the only prayer which remains to be considered is for issuance of a direction to the court below to decide the recall application filed by the petitioner in a time bound manner.
The recall application filed by the petitioner along with certain other persons is for setting aside the ex parte decree passed in Original Suit No. 266 of 2012. The application was filed in the year 2018. It has been registered as Misc. Case No. 247 of 2018.
Having regard to the facts of the case, the instant petition is disposed of with direction to the trial court to make serious effort to decide the said application expeditiously by fixing short dates and without granting unnecessary adjournment to either of the parties.
