Heard Sri Anoop Kumar Khare holding brief of Shabana Nizam, learned counsel for the petitioner and Sri Satish Kishore Kakkar, learned counsel for the respondents.
The only prayer in the present petition is for a direction the the District Judge, Jalaun at Orai to decide the SCC Suit No. 04 of 2016 (Rajesh Kumar vs. Branch Manager, Allahabad U.P. Gramin Bank and another) which is said to be pending in the court of the District Judge, Jalaun at Orai since 2016.
Learned counsel for the petitioner relying upon the order sheet which has been filed along with the petition has submitted that although various dates are being fixed but for some reason or other the matter is being adjourned, and the pendency of the suit is causing undue hardship to the petitioner.
In view of the aforementioned facts and circumstances, the present petition is disposed of with an observation that in case the petitioner appears in the proceedings and does not seek any unnecessary adjournment it is expected that the court concerned would make an endeavour to decide the aforesaid case expeditiously in accordance with law provided there is no other legal impediment.
