Heard learned counsel for the petitioner and learned AGA for the State.
By means of the present petition the petitioner is assailing the order dated 04.10.2018 passed by learned CJM, Farrukhabad in Misc. Case No.1010/11/2018, by which the application under Section 156(3) Cr.P.C. was rejected.
Learned counsel for the applicant submit that he does not want to press this present petition.
In view if the above, the present petition is dismissed with a liberty to avail a proper remedy available under Cr.P.C.., accordingly, the petition is dismissed as withdrawn with liberty as prayed.
Officer is directed to return the certified copy of the same to learned counsel for the petitioner on his supplying photocopy of the same within fifteen days.
