At the very outset, learned counsel for the petitioner submitted that he may be permitted to correct the prayer clause.
Prayer aforesaid is granted. He may do so during the course of the day.
Heard learned counsel for the petitioner.
Present writ petition has been filed seeking a direction to the respondent no. 1 to decide Suit No. 309 of 2003 expeditiously and command the respondent no. 2 not to take unnecessary adjournment.
Learned counsel for the petitioner states that the evidence of P.W. 1 has already been recorded.
In the facts and circumstances of the case, the present writ petition is finally disposed of with the direction to the Judge, Small Causes Court, Varanasi to expedite the hearing of the aforesaid suit and decide the same on its own merit, in accordance with law, expeditiously provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
With the aforesaid observations/ directions, the present writ petition is finally disposed of.
