Briefly stated facts of the present case are that Original Suit No.934 of 2008 (Ram Vijay Singh v. Champa Devi and others ) was filed for cancellation of sale deed dated 3.10.2008, which is said to have been executed by the defendant No.2, Indra Bahadur Singh in favour of the defendant-petitioner. The defendant-petitioner has filed a written statement on 24.2.2009. She also filed a Naksha-Nazri along with her written statement. After about six years of the filing of written statement, the defendant-petitioner filed an amendment application being paper no.131Ga2 to amend certain paragraph of her written statement and also to amend Naksha-Nazri. She filed a new Naksha-Nazri along with amendment application. The amendment application was rejected by the Civil Judge (Junior Division )/FTC, Ballia by the impugned order dated 4.2.2016, recording a finding that the amendment application has been filed belatedly and by the amendment application the defendantpetitioner wants to change her admission made in the written statement. The Civil Revision No.50 of 2016 filed by the defendant-petitioner to challenge the aforesaid order dated 11.4.2016 has been dismissed by the Additional District Judge/FTC-II, Ballia, by the impugned order dated 10.12.2018.
