Heard Sri Yatharth Srivastava, Advocate holding brief of Sri Dhiraj Srivastava, learned Counsel for petitioner and learned AGA for State-respondents.

Present petition has been filed under Article 227 of the Constitution of India with a prayer that court concerned be directed to decide the trial of Criminal Case No.3231 of 2016, Saurya Trading Vs. M/s Sapna Constructions, under Section 138 of Negotiable Instruments Act, Police Station Kalyanpur, District Kanpur Nagar pending in the Court of Additional Chief Metropolitan Magistrate, Court No.10, Kanpur Nagar expeditiously within a stipulated period.

Learned counsel for the petitioner argued that matter is urgent and petitioner is suffering from delay disposal of case, the court concerned may be directed to decide the case as mentioned above expeditiously within a time frame as determined by this Court.

Learned AGA for State has no objection to aforesaid request.

Keeping in view of circumstances of the case and the submissions made by the learned counsel for the parties, petition under Article 227 of the Constitution of India is finally disposed of with direction to Court concerned to decide the aforesaid case expeditiously, fixing short dates in the matter preferably within a period of four months from the date of production of certified copy of this order before the Court concerned, if there is no other legal impediment.

With the above observations, the petition under Article 227 of the Constitution of India stands disposed of.
