Hon'ble Manoj Misra,J.
Sri Manoj Nigam, who appears for the respondent no.2-bank, has informed the Court that the petitioner has not disclosed full facts inasmuch as the petitioner has claimed that recovery is being made in respect of a loan account which has already been cleared by the petitioner but, in fact, the petitioner had obtained two separate credit facilities. One was in respect of Loan Account No. A 19/51 and the other was in respect of Loan Account No. D 36/38 and the present recovery proceeding is in respect of second Loan Account No. D 36/38. The Court has also been informed that the petitioner has suppressed filing of Suit No. 303 of 2017.
In view of the above, the learned counsel for the petitioner prays to withdraw this petition.
The petition is dismissed as withdrawn .
