Heard Sri Azhar Hussain, learned counsel for the petitioner and Sri Pankaj Srivastava, Advocate, holding brief of Sri Satish Chaturvedi, learned counsel for the respondents.

Upon instructions, learned counsel for the petitioner states that a sum of Rs.58,312.76 is still outstanding against the petitioner. A copy of the statement has been filed on record and the copy of the same has also been made available to the learned counsel for the petitioner.

In view of the above, no useful purpose would be served in keeping this writ petition pending, since the petitioner is claiming no dues certificate from the bank while the bank is claiming certain amount to be still outstanding against the petitioner.

Accordingly, the present writ petition is disposed of with the following directions:-

(i) The petitioner may file proper representation/objection before respondent no. 2 within a period of three weeks from today alongwith a certified copy of this order.

¶10

(ii) Upon such representation/objection as to the balance amount being filed, the respondent bank will be under an obligation to decide the same by a reasoned order within further one month therefrom.

Subject to the outcome of such representation, the bank may issue a no objection certificate or the petitioner who may deposit the due amount within a further period of six months from the communication of the decision by the bank.
