Heard Sri Adarsh Bhushan, learned counsel for the petitioner and Sri Harish Chandra Dubey, learned Standing Counsel appearing for the State respondents and perused the record.

At the very outset, learned counsel for the petitioner has pointed out that the name of Sri Ajay Kumar Pandey, learned counsel has wrongly been shown as counsel for the respondents whereas he is also appearing for the petitioner.

Office is directed to correct the mistake.

Present petition has been filed seeking writ of mandamus directing the respondent no. 2 to conclude the enquiry proceedings and pass final order under Section 95(1)(g) of the Panchayat Raj Act, 1947 contemplated against respondent no. 3.

Drawing attention to annexure 8 to the writ petition, submission of learned counsel for the petitioner is that although a show cause notice dated 20.4.2018 has already been issued to the respondent no. 3, however, till date no final decision has yet been taken.

In such view of the matter, present petition stands disposed of with a direction to the respondent no. 2-District Magistrate, Agra to conclude the enquiry within time as provided in the Uttar Pradesh Panchayat Raj (Removal of Pradhans, Up-Pradhans and Members) Enquiry Rules, 1997.

Since the time as provided in the Rules has already expired, therefore, it is expected that the proceedings shall be concluded finally as expeditiously as possible, preferably within a period of three months.

With the aforesaid observations/directions, present petition is accordingly disposed of. No order as to costs.
