The grievance of the petitioner is that though the award made by the Arbitrator under sub-section (5) of Section 3G of the National Highways Act, 1956 has been set aside by the District Judge, Agra in proceedings under the Arbitration and Conciliation Act, 1996, the Arbitrator has not proceeded to make a fresh award.

It does transpire from a perusal of the judgment dated 25 August 2017 passed by the District Judge, Agra that the objections filed by the petitioner were allowed and the award of the Arbitrator was set aside. Such being the position, the Arbitrator has to make a fresh award in accordance with the observations made in the judgment.

Sri Sabhajeet Singh appears for respondent no.1, Sri Pranjal Mehrotra appears for respondent nos.2, 3 and 4 while the learned Standing Counsel appears for respondent nos.5 and 6.

It is for the petitioner to approach the Arbitrator with a copy of the judgment dated 25 August 2017 passed by the District Judge, Agra so as to enable him to proceed in the matter.

The writ petition is, accordingly, disposed of with the aforesaid observation.
