By Resolution dated 13.07.2018 Ashiyana Upwan Residents Welfare Association decided to impose a fine upon petitioner in tune of Rs.1,000/per day for raising construction unauthorizedly. Being aggrieved by the same, the petitioner is alleged to have submitted a representation before the Secretary, Ghaziabad Development Authority but that was not accepted.

It is submitted by learned counsel appearing on behalf of the petitioner is that in similar circumstances the Officer on Special Duty, Ghaziabad Development Authority under a communication letter dated 30.7.2018 (Annexure-4) restrained Ashiyana Upwan Residents Welfare Association from imposing penalty till completion of enquiry. According to learned counsel, non acceptance of the application submitted by the petitioner is highly discriminated.

Per-contra learned counsel for the Ghaziabad Development Authority submitted that petitioner never approached the authority concerned for redressal of his grievance.

Be that as it may, having considered the submissions, we deem it appropriate to dispose of this petition for writ by directing the Secretary, Ghaziabad Development Authority to accept the grievance application submitted by the petitioner and further to decide the same in accordance with law.

The petition for writ stands disposed of.
