Upon instructions received, learned Standing Counsel states that the benefit of the loan waiver scheme could not be granted to the petitioners earlier since in the application form filled up by the petitioners, the bank account number as disclosed did not match with the bank records. Consequently, the application forwarded by the District Magistrate, Shahjahanpur to the bank with such details came to be returned to the District Magistrate, Shahjahanpur by the bank.

In absence of any clarification as to whether the bank account number would be corrected, the matter remained pending in the office of the District Magistrate, Shahjahanpur.

Presently, in view of the instructions issued by the State Government dated 28.09.2018, the District Magistrate, Shahjahanpur has been permitted to make corrections in the details of the bank account.

In view of the above, it has been submitted by learned Standing Counsel that the District Magistrate, Shahjahanpur has made the necessary corrections and has forwarded the claim of the petitioners which is otherwise eligible for grant of loan waiver i.e. to the respondent-Bank, Baroda Uttar Pradesh Gramin Bank, Branch Jujharpur, District- Shahjahanpur. Further, it has been submitted that the petitioners' claim has been found to be eligible to loan waiver.

Sri Parshuram Chaubey, learned counsel for the respondent-Bank states that according to his instructions, the bank has yet not received the corrected application from the office of the District Magistrate, Shahjahanpur.

In view of the above, no useful purpose would be served in keeping the present writ petition pending any further. It is disposed of with a direction that the corrected application for grant of loan waiver submitted by

the petitioners shall necessarily be forwarded by the District Magistrate, Shahjahanpur within a period of one week from today, if that application has yet not been forwarded. Upon its receipt, the respondent-Bank shall communicate that fact to the petitioner by way of written communication. It is expected that the entire process would be completed within a period of one month from today and the loan waiver as prayed, to the extent permissible would be granted to the petitioners within that period.
