This Court is thankful to Sri Ravikant, Senior Advocate assisted by Sri Rohit Ranjan Agrawal, learned counsel for petitioner, Sri Avinash Pandey, learned counsel for respondents and Sri Amarnath Arun ( AGM(Legal) and Sri Rajeev Tomar ( DGM( HR) the Officer of M/s Wave Industries Private Limited and the Company who have deputed the people and brought about the happy end to this long litigation of 22 years.

The U.P. State Sugar Corporation Limited Unit Saharanpur which is now purchased by M/s Wave Industries Private Limited. The petition is deemed to have been amended. The parties were present in this Court and are requested to mediate this matter as the petition is of the year 2002 which is an accepted position by the erstwhile workman namely Pankaj Kumar Tomar who does not do any work except he has started his own profession as Advocate since 2009.

We may not go into the genesis what would happen if the matter is heard or argued on merits as the parties have decided to bring this litigation to an end. The private petitioner shall deposit a demand draft of Rs.1,50,000/- drawn of bank on or before 15th August, 2018 and the remaining amount amounting to Rs.75,000/- would be deposited on or before 23rd August, 2018. Before 10th August, 2018, the Registry of this High Court will transmit the order to Authority where the cheque /

demand draft / pay order of the amount deposited by petitioner, if any.

Petitioner will be at liberty to withdraw the amount already deposited by the petitioners before Deputy Labour Commissioner, Saharanpur with the interest which must have accrued on it without furnishing any security.

The petition stands disposed of. However, the settlement deed and the compliance report be filed before the undersigned on or before 30th August, 2018. The Registry to place the matter on 31st August, 2018 at 2.00 p.m. only for this purpose.

A copy of this order to be sent to Deputy Labour Commissioner, Saharanpur for compliance.
