This writ petition has been filed seeking quashing of the order dated 26.5.2018 passed by the Sub Divisional Magistrate, Dudhi, Sonbhadra, respondent No.1, whereby the respondent No.1 has requested the respondent No.3 not to allow the petitioner to operate his bank A/c No.07320100007726 and the locker, until further order in view of recovery of Rs.18,89,969/pending against him.
Admittedly, an award by the MACT-II in A.D. Case No.147/2007 (Prabha Devi v. Rajmani Thakur) has been passed against the petitioner by the Motor Accident Claim Tribunal. It appears that pursuant to the said award, recovery proceeding has been initiated against the petitioner.
After the arguments were heard at some length, learned counsel for the petitioner states that the petitioner wants to withdraw the writ petition with liberty to approach the appropriate forum for redressal of his grievances.
In view of the aforesaid request, the writ petition is dismissed as withdrawn with liberty to the petitioner to approach the appropriate forum.
