Heard learned counsel for the parties.

It has been urged on behalf of the petitioner that the order dated 31.3.2017 passed by the Deputy Labour Commissioner, Bareilly i.e. respondent no.2 is wholly without jurisdiction inasmuch as the claimant-respondent no.4 had in his claim application described himself as in Working Journalist while in the objection raised to that claim the petitioner had at the first instant itself stated that the said respondent had been appointed as a Assistant Manager and, therefore, by virtue of Section 2(dd) read with Section 2(f) of Act No. 45 of 1955 the said respondent fell out side the scope of its applicability because he was engaged an administrative or supervisory capacity."

Learned counsel for the parties state that the issue involved in the present petition is squarely covered by the earlier decision of the Court in the case of Hindustan Media Ventures Ltd. Vs. State of U.P. & Others reported in 2017 (9) ADJ 588.

In view of the above, learned counsel for the respondents also does not propose to file any counter affidavit.

The controversy involved in this petition is squarely covered by the earlier decision in the case of Hindustan Media Ventures Ltd. (supra). Accordingly, this writ petition is allowed on the same terms and conditions.
