Heard learned counsel for the petitioner and Sri Gyan Prakash Srivasatava, learned counsel for the respondent/Bank.

The present writ petition is directed against the recovery citation dated 2.4.2018 for recovery of Rs. 4,15,348/-

¶5

At the outset, learned counsel for the petitioner submits that the petitioner is ready and willing to pay the entire outstanding loan alongwith up-to-date interest in easy installments.

To this submission of learned counsel for the petitioner, Sri Gyan Prakash Srivastava learned counsel for the respondent-Bank raises no objection.

In view thereof, without expressing any opinion on the merits of the claim of the petitioner, the present writ petition is being disposed of with the directions as follows:-

(i) 50% of the total outstanding loan amount with up-to-date interest shall be paid within a period of two months from today.

¶9

(ii) In case, the petitioner makes the deposit as directed above, the respondent/Bank shall issue statement of account and the rest of the installments of the outstanding loan amount shall be allowed to be deposited in easy equal installments of one month.

(iii) In the event of default in any of the installments, it would be open to the respondent/Bank to recover the amount forthwith.
