The petitioner contends that a complaint was forwarded by the Waqf Board by a letter dated 06.11.2017 with regard to the illegal construction on plot no. 163. The District Magistrate has passed the order directing stoppage of the construction based on which order, the construction that it being raised by the petitioner on plot no. 493-M has been stopped. The contention of the petitioner is that he has nothing to do with plot no. 163 and therefore the authority should be directed not to interfere in the construction on plot no. 493-M.

In this regard, he has also brought on record facts stating that two complaints were previously made in similar fashion in which inquiry was made and it was found that the petitioner is not raising any construction on plot no. 163. Those complaints were accordingly consigned to the records.

In light of the aforesaid, we dispose of the matter directing the District Magistrate to look into this matter as to whether any construction is being raised on plot no. 163 or in plot no. 493-M and pass further orders within five working days from the date of production of a certified copy of the order.
