The petitioner, who was a student of LL. B. in Sri Giriraj Maharaj College of Law and Professional Studies, Mathura, which is affiliated to Dr. Bheem Rao Ambedkar University, Agra, has filed the instant writ petition seeking a direction commanding the respondent Nos. 2 & 3 to permit him to appear in re-examination of the Ist year examination of LL. B., as left out student.

The case of the petitioner is that he could not pass the Ist year examination and therefore, he appeared in the re-examination along with IInd year examination. He failed in the reexamination, but succeeded in passing the IInd year examination. He is also stated to have passed the IIIrd year examination. Now he wants to clear the Ist year examination and in this respect he is placing reliance on a communication issued by the Examination Controller dated 20.4.2018 (Annexure 7 to the writ petition).

Sri Vivek Verma, learned counsel appearing on behalf of the respondent University states that the Examination Controller will examine the case of the petitioner in the light of the communication dated 20.4.2018.

Accordingly, the instant writ petition is disposed of with liberty to the petitioner to approach the Examination Controller (the second respondent) with a certified copy of this order and a fresh representation, and in which event, the second respondent

shall pass a speaking order, having regard to the communication dated 20.4.2018, within a period of next four weeks.
