Heard learned counsel for the petitioner.

Notice on behalf of respondent no. 1 has been accepted by the Assistant Solicitor General of India. Shri Tarun Verma has accepted notice on behalf of respondents no. 2 and 3.

This writ petition has been filed by the petitioner with the following prayer:

(i) to issue an appropriate writ, order or direction in the nature of certiorari quashing the impugned order dated 28.3.2018 (Annexure No.1) to this writ petition and further prayed that this Hon. Court may cancel the distributorship of the respondent no.4 which was illegally allotted by the concerned respondents.

(ii) to issue an appropriate writ, order or direction in the nature of mandamus directing the respondent no.2 and 3 to make a fresh enquiry for the L.P.G. distributorship advertised on 28.10.2016 at serial No. 257 within stipulated period of time.

It is contended by learned counsel for the petitioner that the respondent no.2 while rejecting the representation filed by the petitioner before him with the prayer for cancelling the appointment of respondent no. 3 as L.P.G. Distributors in Maroofpur, Block Kaurihar, District Allahabad has not applied his mind to the facts and circumstances of the case and material on record and as such the impugned order can not be sustained and is liable to be quashed.

Per contra, Shri Tarun Verma, learned counsel for respondent nos. 2 and 3 has refuted the submissions of learned counsel for the petitioner.

After hearing learned counsel for the parties and perusing the impugned order we find that the petitioner no. 1 is seeking cancellation of appoint of respondent no. 4 as LPG distributor in Maroofpur, Block Kaurihar, District Allahabad mainly on the ground that the land on which the respondent no.4 has set up his LPG Retail outlet is an agricultural land of which respondent no.4 alongwith one

Bimla Devi is co-owner. The respondent no. 3 while rejecting the representation made by the petitioner before him with the prayer for cancellation of appointment of respondent no.4 as LPG Distributor by its impugned order has clearly recorded there that there was no violation of any Rule by appointing the respondent no. 4 as LPG Distributor for Maroofpur, Block Kaurihar, District Allahabad.

The impugned order in our opinion does not suffer from any illegality or infirmity requiring any interference by this Court.

This writ petition lacks merit and is dismissed.
