Heard learned counsel for the petitioner and learned Standing Counsel for the State.

The contention of Sri Jamil Ahamad, learned counsel for the petitioner is that a resolution was passed by the Village Panchayat Nibahi, District Deoria on 26.3.2018 to appoint the petitioner as the fair price dealer of the aforesaid village panchayat. It is contended that the resolution was passed in accordance with law and the petitioner is fully eligible to be appointed as the fair price shop dealer of the aforesaid village panchayat. Further no action has been taken on the aforesaid resolution passed by the village panchayat. The petitioner has also submitted a representation in this regard to respondent no.3.

Sri Sanjay Ram Tripathi, learned Standing Counsel contends that the resolution has to be processed by the Tehsil Level Committee before a formal order of appointment is issued by the respondent no.3.

No useful purpose would be served by keeping this writ petition pending in this court. With the consent of learned counsel for the parties the matter is being disposed of finally at the admission stage.

In view of the facts and circumstances, the respondent no.3 is directed to ensure that all formalities are completed by the Tehsil Level Committee for appointment of fair price shop

dealer as well as the subsequent documentation and issuance of the appointment letter is done within a period of one month from the date of production of certified copy of this order.

It is made clear that Tehsil Level Committee as well as the S.D.M. shall independently apply their minds to the case and pass appropriate orders in the matter. This court has not gone into the correctness of the assertions made in the writ petition.

With aforesaid observation present writ petition stands disposed of.
