Heard Sri Manoj Kumar, learned counsel for the petitioner, learned Standing Counsel for the respondent-State and Sri Junaid Alam, learned counsel for the respondent no. 6.

Petitioner claims to be a handicapped person. He claims to suffer from 60% disability in his legs. He has brought the certificate attesting to his handicapped in record. The government policy of appointment of fair price shop dealership contemplates reservation of fair price shop dealership for category of handicapped persons.

The submission of learned counsel for the petitioner is that in Village Panchayat, Nagala Dal Tehsil Tundala, District Firozabad is liable to be reserved under the physically handicapped quota. Further in view of the government policy the petitioner is entitled to be considered for appointment as fair price shop dealer for Village Panchayat, Nagala Dal, Tehsil Tundala, District Firozabad under the quota reserved for physically handicapped person. The petitioner has made a representation in this regard. However, the representation has not been decided.

No useful purpose will be served by keeping this writ petition pending.

The respondent no. 2, District Magistrate, Firozabad is directed

to ensure that the government policy regarding reservation of fair price shop dealership in various village panchayats for person under the handicapped category are duly identified and reserved. The respondent no. 2 shall ensure that the rights of the handicapped persons are not prejudiced or defeated by failure of the State authorities to identify and reserve the fair price shop dealership in village panchayats for physically handicapped persons. Thereafter in case, the fair price shop dealership of Village Panchayat, Nagala Dal, Tehsil Tundala, District Firozabad is earmarked and reserved for appointment of physically handicapped candidates, the case of the petitioner shall be considered along with other eligible candidates in the said category.

The entire exercise shall be completed within a period of three months from the date of production of a certified copy of this order along with fresh copy of representation.

With the above direction, the writ petition is disposed of finally.
