The principal prayer made in the instant writ petition is as under:-
" issue a writ, order or direction in the nature of mandamus commanding the Controller of Examination, Dr. A.P.J. Abdul Kalam Technical University, Lucknow (respondent no.3) to get the back-papers' examination of petitioner for the II-semester of Master of Technology (Machine Design) conducted forthwith and also to accept the project of the petitioner for the IV-semester examination of the aforesaid course and issue final Degree to the petitioner, if he found successful in all the semester examinations."
On 9.4.2018, the following order was passed:-
"Sri Rohit Pandey, learned counsel appearing on behalf of the respondent Nos. 2 & 3, seeks time to obtain instructions, as to why second semester carry over examination, was not conducted by the University, as alleged by the petitioner in paragraph 14 of the writ petition, despite an assurance to him by letter dated 23.2.2017, to conduct such examination.
Put up as fresh on 18.4.2018."
Today, when the matter is taken up, Sri Rohit Pandey, learned counsel appearing on behalf of respondent University, on instructions, states that the University is still ready to take back paper examination of the petitioner for the second semester of Master of Technology (Machine Design), provided the petitioner contacts the Controller of Examination, respondent no.3 within two weeks from today.
Counsel for the petitioner states that the petitioner would contact the third respondent.
Accordingly, the instant petition is disposed of on the assurance given by learned counsel appearing on behalf of the respondent University that in case the petitioner contacts the third respondent within two weeks from today, he will ensure that the examination of the petitioner relating to second semester of Master of Technology (Machine Design) is taken thereafter.
