Heard Shri B. P. Chaubey, learned counsel holding brief of Shri B. K. Ojha, learned counsel for the petitioner and learned Standing Counsel for the State-respondent.
Shri B. P. Chaubey, learned counsel holding brief of Shri B. K. Ojha, learned counsel for the petitioner contends that the fair price shop licence of the petitioner was suspended and a show cause notice was issued on 31.7.2017. The petitioner has submitted his reply to the show cause notice refuting the allegations made therein on 19.12.2017. The matter is pending since long. The only prayer made by the learned counsel for the petitioner at this stage is that the respondent No. 2 may decide the matter on its merit after considering the reply to the petitioner and the prayers made therein.
The learned Standing Counsel does not have any serious objections to the aforesaid prayer.
In the light of the aforesaid submissions, the respondent No. 2 is directed to decide the matter on its merit within a period of one month from the date of receipt of certified copy of this order.
With the aforesaid observation/direction, the writ petition stands disposed of.
