The fair price shop license of the petitioner for village Bankauli, Block Baheri, District Bareilly was terminated by order dated 9.2.2018. The petitioner instituted an appeal in the court of Commissioner, Bareilly assailing the order of termination of his license. The appeal was registered as Appeal No.57/18. By the order impugned in the writ petition, the stay application in support of the memo of appeal has been rejected by the appellate authority. No legal ground has been pointed out, which would warrant interference in the order passed by the appellate authority rejecting the stay application of the petitioner. The reliefs sought in the writ petition are rejected. In the event of cancellation of license of fair price shop dealer the beneficiaries of the distribution scheme of the State Government and card holders are put to inconvenience in case alternative arrangements are not put in place. It is open to the State Government and the respondents authorities to place alternative arrangements for supply of essential commodities of the card holders. The interest of the card holders should be protected at all costs and the supply of essential commodities should remain uninterrupted.In such view of the matter there is no cause for interference in the order passed by the appellate authority. However, it would be appropriate in the interest of justice to direct the appellate authority to decide the appeal filed by the petitioner within a period of three months from the date of submission of certified copy of this order. It is further provided that any third party rights if created would remain subject to the decision of the appeal.
