It appears that the petitioner had earlier filed a writ petition bearing Writ Petition No. 43492 of 2016, challenging the assessment order. We are informed that the amount demanded as per the assessment order was about 13 lacs and odd. That writ petition was disposed of with liberty to the petitioner to file an appeal under Section 127 of the Electricity Act, 2003. Though, counsel for the petitioner submits that the petitioner filed an appeal, he is not in a position to state whether an amount has been deposited by the petitioner. It is also not clear whether the appeal is still pending or it has been dismissed for non-compliance of the condition of pre-deposit under Section 127(2) of the Act. It is pertinent to notice that the petitioner had filed one more petition bearing Criminal Misc. Writ petition No.19507 of 2016, challenging the FIR dated 21.1.2016, for the offence punishable under Section 127(2) of the Act. In that writ petition, the petitioner had given an undertaking to clear all electricity dues in question.
