Aggrieved by the notice dated 23.12.2017 issued by the Investigation Officer requiring the petitioner to appear along with registration papers of motorcycle, the instant writ petition has been filed.
The aforesaid notice was issued during the course of investigation of Case Crime No. 303 of 2014, under Sections 147, 148, 149, 302, 307, 504, 506 I.P.C. and Section 7 of Criminal Law Amendment Act registered at P.S. Industrial Area, District Allahabad.
It appears that during investigation, there was some intimation that the motorcycle bearing Registration No. UP-70-BX2374 was involved in the incident and since the same has been registered in the name of the petitioner, he has been asked to appear before the Investigation Officer.
We see no illegality in the notice so as to warrant any interference by this Court. The petitioner is under obligation to respond the said notice and produce the necessary documents as required by the Investigation Officer and cooperate in the investigation.
Accordingly, the writ petition stands dismissed.
