During the consolidation operations held in the village and as a result of objection filed by the petitioner under Section 20 of the Uttar Pradesh Consolidation of Holdings Act, 1953 (hereinafter referred to as, Act, 1953'), a chak road was provided for the chak of the petitioner who was chak holder No. 68 comprising of Plot Nos. 161 and 162. The aforesaid chak road was provided on Plot No. 109 which was initially outside the consolidation scheme. Subsequently, respondent no. 2 who is chak holder No. 18 also filed an objection under Section 20 of the Act, 1953 praying that a Nali may be provided in his chak. The said objection was dismissed by the Consolidation Officer vide his order dated 3.9.1985. Against the order dated 3.9.1985 passed by the Consolidation Officer, respondent no. 2 filed an appeal before the Settlement Officer of Consolidation praying that he may be allotted a chak on Plot No. 109. The said appeal was dismissed by the Settlement Officer of Consolidation vide his order dated 30.11.1985. Against the order dated 30.11.1985 passed by the Settlement Officer of Consolidation, respondent no. 2 filed a time barred revision before respondent no. 1 which was registered and numbered as Revision No. 389. Respondent no. 1 vide his judgment and order dated 30.9.1986 allowed the aforesaid revision and removed the chak of the petitioner from Plot No. 109. The order dated 30.9.1986 has been challenged in the present writ petition.
