By means of present writ petition, petitioner seeks a direction commanding the second and third respondents to grant permission to the petitioner institution to fill up the vacant post of Clerk in petitioner Institution namely Vivekanand Intermediate College, Narani, District Banda
Learned counsel for the petitioner has apprised to the Court that relevant papers have already been sent to the Director of Education (Secondary) U.P. at Lucknow on 12.09.2017 by the District Inspector of Schools, Banda but the same is still pending consideration before the authority concerned and as such request has been made to direct the Director of Education (Secondary) U.P. at Lucknow to take a final call in the matter.
Learned Additional Chief Standing Counsel has not opposed the said prayer.
In view of the above, without expressing any opinion on the merits of the case, on consent, the Writ Petition is disposed of asking the Director of Education (Secondary) U.P. at Lucknow to take a final call in the matter on the basis of recommendations made by the District Inspector of Schools, Banda preferably within a period of two months from the date of production of certified copy of this order.
