Heard learned counsel for the petitioner; learned Additional Chief Standing Counsel for the State respondents and Shri C.K. Rai, Advocate who appears for the fourth respondent.

Petitioner is before this Court with the request to command the first respondent to approve the proposal dated 18.09.2017 submitted by the respondents/Secretary Basic Shiksha Parishad U.P. at Allahabad within stipulated period. Further prayer has been made to direct the respondents to correct the pay grade and pay band and designation by modifying the Government Order dated 16.12.2016 regarding the petitioner as well as other employees of Parishadiya, Basic Shiksha Parishad U.P. at Allahabad, in pursuance of reference dated 18.09.2017 submitted by Secretary Basic Shiksha Parishad, U.P. at Allahabad within stipulated period.

Record in question reflects that for according and forwarding the correct pay band structure for approval, petitioner has been before this Court by preferring Writ A no.13429/2017 (Tarun Kumar Dubey vs. State of U.P. and others) . The aforesaid writ petition, at the admission stage, was disposed of vide order dated 30.03.2017 asking the fourth respondent Secretary, Basic Shiksha Parishad, U.P. at Allahabad to pass appropriate order in the matter.

Learned counsel for the petitioner apprised to the Court that in response to the directives so issued by this Court in the aforesaid writ petition, the Secretary, Basic Shiksha Parishad, U.P. at Allahabad has already forwarded the papers way back on 18.09.2017 and reminders have also been sent on 28.12.2017, 04.01.2018, 12.01.2018 but no action has been taken by the State Government and due to such inaction on the part of the respondents, the petitioner is again before this Court with the abovementioned prayer.

Learned Additional Chief Standing Counsel as well as Shri C.K. Rai, Advocate has not disputed the said situation and very fairly submits that in case any such claim of the petitioner is still pending, the same shall be decided by the Authority concerned at the earliest.

In view of the above, without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, the Writ Petition, on consent, is disposed of asking the Additional Chief Secretary/Secretary, Department of Basic Education, Government of U.P. at Lucknow to look into the grievance of the petitioner and pass appropriate order on the letter dated 18.09.2017 forwarded by the Secretary, Basic Shiksha Parishad, U.P. at Allahabad in accordance with law, as early as possible, preferably within a period of two months from the date of production of certified copy of this order.
