The petitioners are before this Court for a direction to second respondent i.e. District Social Welfare Officer, Distt. Allahabad to give appointment the second petitioner under Dying-inHarness Rules.
The record in question reflects that the husband of the first petitioner namely Late Radhey Shyam was working as Assistant Teacher in Junior Basic School, Galla Bazar, Bari Bagiya, Distt. Allahabad since 02.08.1984. He died-in-harness on 28.12.2014 leaving behind his wife, two sons and one daughter. At the time of death, the second petitioner, who is elder son of the deceased employee was minor. At the moment he has attained majority, the first petitioner (mother of second petitioner) represented for giving him compassionate appointment in the year 2015 but no action has been taken on it. It is contended that there is no source of livelihood and the family is at the verge of starvation and as such this Court should come for rescue and reprieve of the petitioners.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the third respondent i.e. District Basic Education Officer, Allahabad to look into the grievance of the petitioners and pass appropriate order in accordance with law expeditiously and preferably within two months from the date of production of certified copy of this order.
