Learned counsel for the petitioners submits that regarding their grievance the petitioners had earlier filed Writ Petition No.13490 of 2016, which was disposed of on 29.03.2016 asking the Joint Director of Education, Azamgarh Region, Azamgarh to consider the matter regarding payment of salary along with arrears of salary in accordance with law. In compliance thereof the claim of the petitioners had been decided by the Joint Director of Education, Azamgarh Region by order dated 18.5.2016. Pursuant to the order dated 18.5.2016, the second respondent started making payment of salary to the petitioners from June 2016 onward but the salary for the period 20.4.2011 to 1.5.2016 was not paid. Aggrieved with the same, he filed Writ Petition No.30233 of 2017 claiming their salary for the period 20.4.2011 to 1.5.2016. In the said writ petition instructions were given by the DIOS through learned Standing Counsel that the petitioners are being paid their salary and so far as payment of salary for the period 20.4.2011 to 1.5.2016 is concerned, there is a order of Joint Director of Education, which was not under challenge in the writ petition. Finally the said writ petition was dismissed as withdrawn on 19.08.2017 with liberty to file fresh writ petition. It is contended that since July, 2017 the salary of the petitioner has been stopped.
