Heard learned counsel for the parties.

By means of this writ petitio, the petitioner has sought relief in the nature of mandamus commanding 2nd respondent to take decision for grant of financial approval.

The appointment of the petitioner has come to be made on 22nd February, 2018 under the provisions as contained under Rule 10 3(2) of the U.P. Recognized Basic Schools (Junior High Schools) (Recruitment And Conditions Of Service Of Teachers) Rules, 1978 as the papers forwarded to him on 31st January, 2018 by the Committee of Management after making selection of the petitioner following due procedure as prescribed for under the Rules, 1978, he had not taken any decision in the matter.

In the opinion of the Court, the matter requires scrutiny on facts in the first instance at the stage of the District Basic Education Officer with regard to the claim of the petitioner and to that aspect Sri Mrigraj Singh, learned Advocate appearing on behalf of respondent no. 2 has no objection.

Let matter be examined by the 2nd respondent in respect of the papers forwarded by the Committee of Management on 31st January, 2018 regarding selection of the petitioner on the post of Assistant Teacher in the institution for grant of financial approval as may be required in the matter at this stage of proceedings. The District Basic Education Officer is expected to pass appropriate orders strictly in accordance with law after hearing the Committee of Management also within a period of six weeks from the date of production of certified copy of this order.

Writ petition is disposed of in view of aforesaid observations and directions.
