The petitioners have been working as Junior Account Clerk in District Rural Development Agency, Allahabad.
The petitioners claim that they have been working as a daily wagers w.e.f. 1994 and 1998 respectively. Learned counsel for the petitioner submits that the petitioners are entitled for regularisation of their services on the footing of certain government orders. The petitioners have already made a representation in this regard. However, the case of the petitioners have not been considered for regularisation.
Heard learned counsel for the parties. None appears on behalf of respondents no.3 and 4. Learned Standing Counsel on behalf of State is present.
No useful purpose would be served by keeping this writ petition pending in this court. With the consent of learned counsel for the parties the matter is being disposed of finally at the admission stage.
The matter is remitted back to the respondent no.4 for consideration of the claim of the petitioners for regularisation of their services. A mandamus is issued to the respondent no.4 commanding him to decide the representation of
the petitioners regarding their claim for regularisation within a period of four months from the date of receipt of certified copy of this order along-with fresh copy of the representation. The Court has not gone into the veracity of the assertions in the writ petition nor has the claim of the petitioner been judged on merits. It is for the competent authority to do so after independent application of mind.
