Rejoinder affidavit filed today is taken on record.

Heard learned counsel for the parties.

Petitioner was appointed on the post of Assistant Clerk in substantive vacancy created due to retirement of one Aditya Pal and he claims that the Manager of the institution advertised the post and due selection of the petitioner was made thereon and appointment letter dated 09.08.1993 was issued in his favour. His further case is that he has joined his services in August, 1993 but despite forwarding of his papers to the District Inspector of Schools, Basti no approval to the appointment of the petitioner was granted and therefore, he approached this Court and by the interim order dated 24.03.1994 direction was issued to pay entire amount of salary which is due to the petitioner or show cause.

A attested copy of the counter affidavit filed on behalf of the Staterespondent is taken on record since the copy of the counter affidavit is not traceable and not on record.

Petitioner has brought on record the order dated 16.12.2009 passed by the District Inspector of Schools, Sant Kabir Nagar whereby he has been promoted on the post of Head Clerk and the same has been approved.

However, the fact remains that initial appointment of the petitioner on the post of Assistant Clerk stills stand disapproved.

In view of the facts and circumstances of the case, this petition is disposed of directing the District Inspector of Schools, Sant Kabir Nagar to take decision on the approval of appointment of the petitioner on the post of Assistant Clerk within a period of six weeks from the date of presentation of a certified copy of this order before him.
