An order dated 26.10.2017, contained in Annexure No. 4 to the writ petition, is assailed in this petition. By the order impugned, petitioner has been restrained from functioning as Home Guard in Company No. 1, City - Pillibhit.

Pursuant to the earlier order of this Court, learned standing counsel has obtained instructions, copy of which has been furnished to the counsel for the petitioner. As per the instructions, petitioner was 24 years of age on the date of appointment and that, he has completed the age of superannuation in the year 2017 and therefore, the order has rightly been passed restraining the petitioner from functioning any further.

It appears that against the order under challenge, petitioner, otherwise, has a remedy of appeal before the divisional commandant. As various issues of facts would require adjudication, it would be appropriate to permit the petitioner to approach the appellate authority, along with certified copy of this order, within a period of four weeks from today. j

In case such an appeal is preferred, the same shall be dealt with by the authority concerned, on merits and in accordance with law, preferably within a period of four months, thereafter.

With the observations aforesaid, this petition stands disposed of.
