Heard Shri Ashok Khare, learned Senior Counsel assisted by Shri Shantanu Khare, learned counsel for the petitioner and learned Standing Counsel for the respondents.

The petitioner in the writ petition is seeking quashing of the order dated 15.03.2018, whereby, the petitioner has been placed under suspension.

Perusal of the order of suspension shows that the allegations against the petitioner are that he does not take interest in filing of the instructions in the High Court pursuant to the order dated 04.01.2018 in Writ Petition No. 63136 of 2017 (Harendra & Others Vs. Deputy Director of Consolidation, Ballia & Others) and that he takes leave without sanction and he did not fix standards and yardsticks for disposal of cases.

However, learned Standing Counsel informs that a chargesheet has already been issued to the petitioner and the departmental proceedings are pending.

In this view of the matter, we dispose of this writ petition with a direction to the respondents to conclude the departmental proceedings pending against the petitioner within a period of three months from the date of receipt of a certified copy of this order.

Needless to say the petitioner shall cooperate in the enquiry and no unnecessary adjournment shall be granted to either of the parties by the enquiry officer.

In the meantime, it is directed that the order of suspension dated 15.03.2018 shall remain in abeyance and shall be subject to any final order which may be passed by the respondents in the disciplinary proceedings.
