The petitioner was appointed as L.T. Grade Teacher on 25.10.1995 on short term vacancy in Janta Uchchatar Madhyamik Vidyalaya, Gaddopur, Jaunpur, a duly recognized institution under the grant in aid from the State Government. The approval of his appointment was granted by the District Inspector of Schools on 15.9.1997 and after payment of salary for five months from July 1998 to November 1998, the same was stopped without assigning any reason and therefore, the petitioner has approached this Court.

By virtue of interim order dated 7.3.2002 petitioner is working and getting his salary.

The only relief prayed by learned counsel for the petitioner is that his regularization in service may be considered under Section 33-G of U.P. Act No.5 of 1982 by the Joint Director concerned.

This writ petition is finally disposed of directing the District Inspector of Schools, Jaunpur and the Committee of Management of the Institution to forward the papers of the petitioner to the Joint Director of Education, Varanasi Region, Varanasi for considering the regularization of the petitioner in service as per Section 33-G of U.P. Act No.5 of 1982 within a period of six weeks from the date of presentation of a certified copy of this order before all the respondents concerned. The Joint Director of Education, Varanasi Region, Varanasi shall take decision thereon within four weeks thereafter.

Till the decision is taken by the Joint Director concerned, no impediment to the working of the petitioner and salary of the petitioner will be caused.
