The petitioner was employed on the post of Tracer in the Revenue Department of the State and has since attained the age of superannuation on 31.01.2009. It appears that while he was in service, criminal proceedings were initiated against him, resulting in petitioner being prosecuted in Sessions Trial No. 33 of 1991, which resulted in his conviction and sentence. Upon a criminal appeal, filed by the petitioner, the conviction has been substituted with payment of fine and the petitioner alleges to have deposited the fine.

Petitioner's grievance is that till date, regular pension has not been released to him and no decision has yet been taken with regard to release of terminal benefits. Interim pension, however, has been sanctioned and is being paid to the petitioner.

While entertaining the writ petition, time was allowed to the learned standing counsel to obtain instructions. Instructions have been obtained, as per which the matter is under active consideration before the State Government and certain clarifications, opinion, etc. have been sought.

In the facts and circumstances, noticed above, it would be appropriate to dispose of this writ petition with a direction upon the respondent no. 2 to consider the petitioner's claim for release of regular pension and for disbursement of other retiral dues, in accordance with law. Required decision shall be taken within three months from the date of presentation of certified copy of this order. All consequential action shall be taken without further loss of time.
