None appears for the petitioner. Mr. Ramanand Pandey, learned Addl. Chief Standing Counsel, appears for the respondents-State.

The primary prayer, made in the writ petition, reads thus:

“i) a writ, order or direction in the nature of mandamus commanding the respondent nos. 1 to 5 to remove the illegal encroachment by respondent no.6 over the hospital land of Gata No. 398 area .0690 hectare which is reserve land and related to the land as 132 and to remove the illegal construction over the land in question by respondent no.6 at an early date as may be fixed by this Hon'ble Court.”

Mr. Pandey, learned Addl. Chief Standing Counsel, for the respondents-State submits that there is no encroachment over Gata No.398, as alleged in the petition. He submits that there exists a Nali on the said Gata.

That seems to be the reason why nobody is coming forward to work it out on merits. We are, therefore, constrained to dismiss the petition for non-prosecution. Order accordingly.
