It has been alleged in the writ petition that plot no. 156 and 171 are gaon sabha plots and the same are recorded as bheeta in the revenue records. The respondents no. 5 to 11 have illegally encroached upon the aforesaid plots and consequently case nos. 2315/2017, 2332/2017, 2313/2017, 2329/2017, 2314/2017, 2317/2017, 2312/2017 were registered under Section 67 of the Uttar Pradesh Revenue Code, 2006 (hereinafter referred to as 'the Code, 2006') read with Rule 67 of the Uttar Pradesh Revenue Code Rules, 2016 ( in short 'the Rule 2016') against the respondents no. 5 to 11 in the court of Tehsildar (Judicial), Tehsil Ghazipur Sadar, District Ghazipur. It has been stated that vide order dated 26.2.2018 passed in the aforesaid cases, the Tehsildar, Tehsil Ghazipur Sadar, District Ghazipur had directed the eviction of respondents no. 5 to 11 from Plot Nos. 156 and 171. However, the aforesaid order was not being implemented by the revenue authorities and therefore the present writ petition has been filed praying for a writ of mandamus commanding the respondent no. 4. i.e. the Tehsildar/Assistant Collector, Tehsil Ghazipur Sadar, District Ghazipur to implement the order dated 26.2.2018 passed in the aforesaid cases registered under Section 67 of the Code, 2006 against the respondents no. 5 to 11.
