Heard learned counsel for the appellant and Sri B.D. Pandey, learned Counsel has put in appearance on behalf of respondent/University.

The present special appeal is directed against the judgment and order dated 25.5.2018 passed by the learned Single Judge wherein it is categorically recorded that as per the instruction nos. 2 and 3 pertaining to examinations for LL.B. course in the University, a candidate would be allowed to join IVth Semester course only in a case, she clears all papers of Ist Semester examination.

Admittedly, the petitioner has not been able to clear one paper namely 'Contract' of Ist Semester examination. She has not even appeared in the back paper examination for a period of three years.

In view thereof, she cannot be said to be eligible to appear in the IVth Semester examination.

The contention of learned counsel for the appellant that there was some confusion in the instructions pertaining to the examinations notified by the University, inasmuch as, it is not clear whether a candidate was required to clear all papers of Ist to IIIrd Semesters examination before appearing in the IVth Semester examination. The said condition cannot be taken as a reason to challenge the order passed by the learned Single Judge, more so, in view of the fact that the instructions clearly state that a candidate who has not been able to clear all the papers of Ist Semester examination, cannot be allowed to appeared in the IVth semester examinations of LL.B. Course.

For the above noted reasons, there is no error of law in the view taken by the learned Single Judge.

The appeal is, accordingly, dismissed .
