This appeal is before us to examine correctness of the order dated 11.08.2017 passed by learned single Bench in Writ - A No. 34451 of 2012.
Sri Kamleshwar Kumar Singh, learned Standing Counsel utterly failed to address the Court about any illegality in the order impugned. Suffice to mention that petitioners earlier preferred a petition for writ, that came to be decided on 30.01.2012. Whatever issue decided was over looked by the appellant-respondents without any rhyme and reason and further without giving any challenge to the findings arrived in the judgment dated 30.01.2012 and order was passed in the same fashion as that was declared bad by this Court.
Learned single Bench after noticing all the relevant facts gave a finding that issue in question was no more resintegra in light of the order dated 07.05.2012 but the Government Authorities failed to look into the judgment passed by this Court and passed an order just contrary to the ratio settled.
As already stated learned Standing Counsel failed to satisfy us about the finding arrived at by the learned single Bench, no interference as such is warranted with the judgment impugned.
The appeal is dismissed.
