Sri Sanjay Tripaghi, learned AGA has informed the Court that father is not in police custody. He further informed that the boy is in the custody of Uttarakhand Police in pursuance of an FIR registered in the State of Uttarakhand. As far as corpus - petitioner no. 3 is concerned, it has been informed that she is also not in police custody.
After arguing at some length, learned counsel for the petitioners has made a statement at the Bar that the instant application may be dismissed as withdrawn with liberty to him to seek appropriate remedy before the appropriate forum at the appropriate stage.
In view of the statement made above, the instant habeas corpus writ petition is dismissed as withdrawn with liberty to him to seek appropriate remedy before the appropriate forum at the appropriate stage.
