Heard learned A.G.A. for the State and perused the judgment impugned to this appeal.
There is huge delay in the lodgement of the First Information Report is the first finding of fact which has proved fatal to the prosecution. The medical evidence shows that there were no such injuries which would fall within the purview of provisions of Section 323 of the Indian Penal Code, 1860 which would bring about the conviction of the accused.
These facts do not go to show that the impugned judgment is so perverse which requires interference of this Court.
Hence, the leave is refused.
Appeal is dismissed.
