This criminal revision is preferred against the order dated 19.09.1991 passed by learned Additional Sessions Judge, Ballia in Case No. 492 of 1991 (State v. Shiv Lakhan and others) whereby the revisionists - Shiv Lakhan and Harish Chandra, and co-accused Surendra and Ravindra were convicted for the offences punishable under Section 323/34 IPC and each of them were sentenced to pay fine of Rs. 200/- and in case of default in payment of fine, simple imprisonment for one month.
As per prosecution version, on 07.11.1988 at about 07.00 A.M., revisionists along with co-accused caused injury to Kavalpatiya, wife of informant Kanglu who was medically examined by Dr. N.C. Srivastava and there were three simple injuries on her person.
P.W.1 informant Kanglu and P.W.2 Kavalpatiya have been examined as witnesses of fact and they have supported the prosecution version.
Perused the impugned judgment and order. From its perusal, it is reveals that there is no illegality or infirmity in the impugned order passed by learned Magistrate.
In view of above, the instant revision is accordingly dismissed.
