Heard counsel for the revisionist and learned AGA.
Learned counsel for the revisionist has challenged the impugned order dated 3.2.2018 passed by Additional Session Judge, Court no. 8, Muzaffar Nagar in Criminal Appeal No. 6 of 2016 whereby the order passed by Juvenile Justice Board has been rejected. In this regard an application on behalf of the applicant was moved for quashing the earlier order declaring opposite party no. 2 as juvenile in conflict with law as he was not afforded any opportunity of hearing.
I have perused the order passed by the appellate court, the appellate court has merely directed to remand back the matter to Juvenile Board with direction to both the parties to lead evidence in respect of the juvenility of the opposite party no. 2. At this stage, I do not find any ground for interfering in the order passed by the appellate court.
The revision is accordingly dismissed.
