Heard learned counsel for the petitioner as well as learned A.G.A. for the State-respondents.

The instant petition has been filed by the petitioner seeking direction to the respondents to ensure fair investigation of case Crime No. 885 of 2017, under Sections 147, 148, 149, 447, 307, 323, 338, 504 and 506 I.P.C., police station Kotwali, district Deoria.

It is submitted by the learned counsel for the petitioner that the first information report was lodged by the petitioner's husband in respect of allotment of petrol pump, which was earlier allotted in favour of the accused persons and thereafter cancelled on account of submission of fake and fabricated certificates by them but the police has not arrested any accused persons who are roaming freely extending threat to life and liberty of the petitioner and her family members. The petitioner’s husband is languishing in jail pursuant to the first information report lodged by one of the accused of the present case. The petitioner is being harassed by the local police who are under the influence of the accused persons. The only ground urged in support of his contention is that the petitioner has no hope of fair and impartial investigation by the police.

Considering the facts and circumstances of this case, it is provided that the Superintendent of Police, Deoria, respondent no. 2, shall look into the matter and shall ensure that the investigation be carried out in a fair and impartial manner and concluded at the earliest preferably within three months from the date of receiving a certified copy of this order.

With the aforesaid direction, this writ petition is disposed of.
