Heard learned counsel for the petitioner and learned AGA for the Staterespondents.

This petition for writ is preferred with a prayer to direct the respondent no.2 to take appropriate action to arrest the accused persons and further to ensure security and protection to the petitioner and his family on account of continuous threat from the accused persons.

This court vide order dated 9.1.2018 noticing seriousness of the matter directed the respondent no.3 to remain present personally before Court. It was informed to the Court subsequently that the investigation of the matter in question has been handed over to the Police Station Daraganj, Allahabad. Noticing this fact a direction was given to the Investigating Agency to proceed with the investigation and to arrive at necessary conclusion as per provisions of Section 173 Cr.P.C. It is also submitted by learned AGA that the investigation has already been completed in the matter and the Investigating Agency is going to file a police report before the competent Court within a period of one week from today.

In view of the facts stated by learned AGA, we do not find any just reason to give any direction to the Investigating Agency to complete the investigation.

The writ petition, in the light of the statement given by learned AGA, is disposed of with expectation that a police report under provisions of Section 173 Cr.P.C. shall be filed by the prosecution within a period of one week from today before the Court competent.
