Heard Sri I.P. Singh Tomar, learned counsel for the petitioner, Sri Deepak Mishra, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.

This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 08.07.2018 registered as case crime no. 1248 of 2018 under section 304-A I.P.C. & Section 3(2) (5A) S.C./S.T. Act & Section 7/9 of the Prohibition of Employment as Manual Scavengers & their Rehabilitation Act 2013, Police Station-Loni, District-Ghaziabad.

Learned counsel for the petitioner submits that Rs. 10 lacs has been paid to the family members of each of the three deceased. The said fact has been mentioned in Para nos. 4, 5 and 6 of the supplementary-affidavit.

Learned A.G.A. opposed the prayer for quashing.

Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.

With the above direction this petition is finally disposed of.
