The present writ petition has been filed for quashing the order dated 4.5.2018 passed by Commissioner, Bareilly Mandal, Bareilly in Appeal No.651 of 2018, Computerized Appeal No.C201812000000651 (Ajay Kumar Verma Vs. State) u/s 6 Goonda Act, P.S. Sindhauli, District Shahjahanpur.

It is stated that only on the basis of solitary case, proceedings of Goonda Act have been initiated against the petitioner, who is otherwise a student. It is contended by learned counsel for the petitioner that Additional District Magistrate (F&R), Shahjahanpur passed an externment order against the petitioner against which the petitioner filed an appeal before learned Commissioner, Bareilly Mandal, Bareilly under Section 3(1) of Goonda Control Act, which appeal has been admitted but the stay application has been rejected.

The present writ petition is finally disposed of with a direction to the Commissioner, Bareilly Mandal, Bareilly to consider and decide the petitioner's pending appeal as expeditiously as possible, in accordance with law, preferably within a period of two months from the date of production of a certified copy of this Court before him.

For a period of two months from today, or till the disposal of appeal, whichever is earlier, effect and operation of the externment order dated 11.4.2018 passed by Additional District Magistrate (F&R), Shahjahanpur, shall be kept in abeyance.
